Darely Terms of Service & End User License Agreement (EULA)

1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of the Darely mobile application, website(s), and related services (collectively, the “Service”), operated by FutureGadgets, Inc. (“Darely,” “we,” “us,” or “our”).

By accessing, browsing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Zero Tolerance Policy for Objectionable Content

Darely maintains a zero-tolerance policy regarding objectionable content and abusive behavior. To ensure a safe and respectful community, you agree that you will not post any content that is defamatory, discriminatory, mean-spirited, sexually explicit, or intended to harass or threaten others.

Any user who violates this policy will have their content removed and their account immediately suspended or terminated.

3. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and disclose information about you. By using the Service, you consent to the practices described in the Privacy Policy.

4. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the consent of a parent or legal guardian.

5. Description of the Service

Darely is a social and interactive media platform for creating, exchanging, and interacting with User Content (photos, videos, audio, text). We reserve the right to modify or discontinue any feature of the Service at any time.

6. User Content Responsibility

You retain ownership of your User Content. However, you grant Darely a worldwide, royalty-free, and transferable license to host, store, and display your content for the purpose of operating the Service. You are solely responsible for your content and the consequences of sharing it.

7. Prohibited Conduct

You agree not to use the Service to:

• Post unlawful, hateful, sexually explicit, or otherwise objectionable content.
• Harass, abuse, threaten, or harm other users.
• Infringe the intellectual property rights of others.
• Upload malware or interfere with the Service’s security features.
• Engage in any unauthorized commercial or automated scraping activities.

8. Content Moderation, Reporting, and Blocking

To comply with safety standards, Darely provides the following mechanisms:

• Filtering: We employ automated and manual tools to filter and moderate objectionable content.
• Flagging/Reporting: Users can report any content or user that violates these Terms directly within the app.
• Blocking: Users can block abusive users at any time. Once blocked, that user’s content will be instantly removed from your feed.
• 24-Hour Enforcement: Darely will review all reports and act within 24 hours by removing the offending content and/or ejecting the user who provided the content.

9. Account Security

You are responsible for maintaining the confidentiality of your credentials. Notify us immediately of any unauthorized use of your account.

10. Mobile Applications and Apple App Store

You acknowledge that these Terms are between you and Darely, not Apple Inc. Apple has no obligation to provide support for the Service. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

11. Intellectual Property

All software, designs, and trademarks (“Service Content”) are owned by Darely or its licensors. You may not copy or redistribute Service Content without express permission.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, particularly for violations of our Zero Tolerance Policy.

13. Disclaimer of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED “AS IS.” BOING DISCLAIMS ALL WARRANTIES AND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

14. Dispute Resolution

Any dispute shall be resolved by binding arbitration on an individual basis. YOU WAIVE THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
