FutureGadgets, Inc., together with its subsidiaries and affiliates (“Boing,” “we,” “us,” or “our”), operates the Boing mobile application and related services (collectively, the “Services”).

Boing is a social and interactive media platform that allows users to create, exchange, and interact with photos, videos, and other content through playful challenges, responses, and social interactions.

We are committed to protecting your privacy. This Privacy Policy (“Policy”) explains how we collect, use, disclose, and safeguard Personal Data in connection with the Services, as well as your rights and choices regarding your Personal Data. Certain features may be limited or unavailable depending on your location to comply with applicable laws.

If you make a purchase, our third-party payment processors collect payment and billing information. We do not store full payment card details.

If you choose to invite or interact with others, including by uploading contacts, you are responsible for ensuring you have permission to share their information.

B. Information Collected Automatically

Device and Technical Data

We collect information such as device type, operating system, app version, IP address, language, time zone, mobile carrier, and general location (city or state level).

Usage and Interaction Data

We collect information about how you interact with the Services, including screens viewed, features used, time spent, navigation paths, interaction flows, and performance or crash data.

C. Information from Third Parties

We may receive information from social media platforms if you interact with Boing content on those platforms, or from other users who interact with you through the Services. Such information is handled in accordance with this Policy.

3. TrueDepth API and Face Data

Boing may use Apple’s TrueDepth API to enable immersive and interactive experiences.

Information Collected

Real-time facial data such as facial position, expressions, and head movement.

Purpose

This data is used solely on-device to power animations, visual effects, or interactive features. It is not used for identification, authentication, or profiling.

Storage and Sharing

TrueDepth data is not stored, is not transmitted to our servers, is not shared with third parties, and is discarded immediately after processing.

4. How We Use Personal Data

We use Personal Data to provide and operate the Services, including account creation, content exchange, and social interactions; to improve and develop features through testing, research, and analytics; to communicate with you regarding service updates, security notices, and support; to ensure safety and integrity through moderation, fraud prevention, and enforcement of our Terms; and to comply with legal obligations.

Where required by law, we rely on your consent. Otherwise, processing is based on contractual necessity or our legitimate interests.

5. How We Disclose Personal Data

We may disclose Personal Data to service providers that help us operate and support the Services, to affiliates within the FutureGadgets corporate group, for legal or safety reasons when required by law or necessary to protect rights and safety, and in connection with business transactions such as mergers, acquisitions, or financing, subject to appropriate safeguards.

Boing does not sell Personal Data.

6. Your Rights and Choices

Depending on your location, you may have the right to access, correct, or delete your Personal Data; object to or restrict certain processing; withdraw consent where processing is based on consent; and receive a portable copy of your data.

Account and Data Deletion

You can delete your account and associated Personal Data at any time. To request account deletion, please contact us at [email protected] with the subject line "Account Deletion Request". Please include the email or phone number associated with your account.

Upon receiving your deletion request, we will delete your account and Personal Data within 30 days, except where we are required to retain certain information for legal or regulatory purposes.

Other Rights

Requests to exercise other rights can be made by contacting us as described below. We may take reasonable steps to verify your identity before fulfilling a request.

7. International Data Transfers

Boing is based in the United States. If you use the Services from outside the United States, your Personal Data may be transferred to and processed in the United States or other jurisdictions that may not provide the same level of data protection as your home country. Where required, we implement appropriate safeguards in accordance with applicable laws.

We retain Personal Data only for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the type and purpose of the data.

Boing is not intended for children under the age of 13, or the minimum age required by applicable law. We do not knowingly collect Personal Data from children.
